Market rates, trading signals, and third-party broker links rely on external telemetry that may experience network delays, slippage, liquidity vacuums, or technical interruptions. Talvurieks bears no liability for discrepancies between platform simulations and actual market fills.
6. Intellectual Property Rights
All intellectual property rights in the Platform—including underlying software, predictive frameworks, machine learning models, UI designs, visual trademarks, brand collateral, and editorial copy—remain the exclusive property of Talvurieks and its licensors. You are granted a limited, revocable, non-transferable, non-sublicensable license to access the Platform strictly for personal, non-commercial purposes in line with these Terms.
7. Limitation of Liability and Disclaimers
To the maximum extent permitted by applicable law in Ireland and the European Union, the Platform is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, statutory, or implied. We expressly disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted uptime.
Under no circumstances shall Talvurieks, its directors, employees, affiliates, or contractors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, capital depletion, lost trading opportunities, or data corruption, arising out of your access to or reliance on the Platform.
8. Indemnification
You agree to indemnify, defend, and hold harmless Talvurieks and its affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Platform, or your violation of any third-party right or applicable law.
9. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Ireland, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts of Dublin, Ireland, and you irrevocably submit to the personal jurisdiction of such courts.
